  1. Purpose & scope of these terms

These General Terms and Conditions of Sale govern all services offered under the Happy French Riviera® brand, a registered trademark and the exclusive property of MARIO TOURS SASU, a single-member simplified joint-stock company with share capital of €1,512, registered with the Nice Trade and Companies Register under number 993 502 335, whose registered office is located at 38 bis, boulevard Victor Hugo – 06000 Nice, France.
Happy French Riviera® designs and operates an exclusive collection of shared or private Legendary Tours, inviting each traveler to discover the French Riviera, Provence, as well as the Ligurian and French Rivieras, through an immersive, silent and elegant experience, crafted with exacting standards and attention to detail, and systematically incorporating additional stops and enhanced points of interest, in order to offer a more comprehensive itinerary than the standard formats usually offered on the market.
Happy French Riviera® voluntarily places its activity within a quality-driven approach in line with the requirements of the “Destination d’Excellence” label supported by the French Ministry of Tourism.
In the same spirit, Happy French Riviera® has chosen a fleet consisting exclusively of electric panoramic vehicles, in order to guarantee silence, comfort and visual immersion while embracing an environmentally respectful mobility approach.
Any reservation constitutes full and unconditional acceptance of these terms.

  1. Reservation & formation of the agreement

The client freely selects one of the shared or private Legendary Tours offered on the website.
Upon completion of the reservation and validation of payment, the client receives a confirmation message for the service.
This message constitutes the formal expression of the agreement binding the client and Happy French Riviera®.

  1.  Payment – Invoicing – Tax compliance

Full payment is required at the time of reservation.
Happy French Riviera® favors secure cashless payment at the time of booking and does not encourage cash payments, except in exceptional circumstances, notably where the bank fees applicable to the client are manifestly disproportionate.
In any event, any service provided automatically gives rise to the issuance of an invoice compliant with the provisions of the French General Tax Code (Articles 256 et seq. and 289 et seq.), clearly showing the applicable VAT.
This invoice is issued in the name of the beneficiary of the Legendary Tour, as indicated at the time of booking, regardless of the identity of the payer, in accordance with the number of accompanying participants.

  1. Happy French Riviera® signature

Each service corresponds to access to one of the shared or private Legendary Tours, as described at the time of booking.
The Tours are carried out aboard a panoramic electric vehicle, ensuring silence, immersion and optimal visibility for each passenger, regardless of seating position.
In order to preserve authenticity and quality of interaction, each vehicle voluntarily accommodates a maximum of eight (8) participants.
Each Legendary Tour includes personalized accompaniment by a tourism escort to share the cultural, historical and natural heritage of the region, as well as all human, technical and logistical resources necessary for its execution.
Included are the elements expressly mentioned in the description of the selected Legendary Tour, such as, depending on the Tours concerned: the boat crossing to Saint-Tropez, access to certain museums, a negotiated 10% discount at Fragonard perfumery, certain meals, the use of a pedal boat or any other activity clearly indicated at the time of booking.
Not included are services not mentioned, personal expenses and gratuities.

  1. Prior information, transfers & meeting point

On the day before the Legendary Tour, the client automatically receives, at their contact email address:
– the exact departure time,
– the precise pick-up location,
– the first name and direct telephone number of the tourism escort,
– the vehicle registration number.
The client is invited to check their “junk / spam” folder. The message is sent from an official address ending in @happyfrenchriviera.com
In order to facilitate smooth communication on the day of the service, passengers are also asked to provide their WhatsApp number at the time of booking, as this application is a cost-free means of communication.
Happy French Riviera® does not voluntarily substitute itself for either the taxi market or the private hire vehicle (VTC) market.
The core of Happy French Riviera®’s activity lies in tourist accompaniment, the design and logistical organization of cultural and heritage-focused itineraries and excursions, and not in the provision of standalone transport services.
At the time of booking, the client may optionally request a private transfer provided exclusively by professional partners specialized in this type of service.
This option is particularly intended for participants staying outside Nice or lacking direct access to the departure point.
Selecting this option does not entail any obligation to subscribe to the transfer service. It merely allows the client, if they so wish, to select a partner suggested by Happy French Riviera® and to benefit, under the conditions specified at the time of order, from a negotiated 10% price advantage, in order to arrive calmly and on time at the designated meeting point.
When the client concludes an agreement directly with the suggested transfer provider, Happy French Riviera® acts exclusively as a facilitator of contact and cannot be held responsible for the execution of this service, which remains the sole responsibility of the provider concerned. No retro-commission is received by Happy French Riviera® in respect of this introduction.
The providers thus suggested have also adhered to the Happy French Riviera® ethical charter, guaranteeing a level of standards consistent with the brand’s values.
Regarding transfers from a place of residence located outside Nice to the meeting point marking the start of the Happy French Riviera® service, suggested providers are selected exclusively on the basis of punctuality, quality of service and propriety, in line with Happy French Riviera®’s own ethical standards, which are consistent with the spirit of the French Ministry of Tourism’s “Destination d’Excellence” label, independently of any volume-driven logic.
All shared Legendary Tours begin and end in Nice.
When access to the initial location in Nice is impossible (pedestrian zone, urban constraints), an alternative meeting point that is the closest and most convenient for the passenger is communicated and becomes the contractual pick-up location.

  1.  Maintenance of shared Legendary Tours

Each shared Legendary Tour is maintained regardless of group size, including in the presence of a single participant.
This policy reflects Happy French Riviera®’s commitment to offering each traveler a level of standards, availability and quality independent of any volume-based considerations.

  1.  Children, legal capacity & group representation

The first person named on the booking order is designated as the beneficiary of the Legendary Tour and acts as the sole representative of the registered group, regardless of whether or not they are the payer for the service.
The beneficiary must be of legal age under French law (18 years). They are the sole contractual contact for Happy French Riviera® for the entire group and are normally present during the Legendary Tour. In the event of an exceptional impediment, they may be replaced by another adult participant in the group, subject to prior notification to Happy French Riviera®, exclusively via the “Client Care” contact form accessible on the secure website https://www.happyfrenchriviera.com before the service departure.
Minor participants may only take part in a Legendary Tour if accompanied, for the entire duration of the service, by the adult beneficiary identified on the booking order or by the adult replacing them in accordance with the preceding paragraph.
Children (up to and including 15 years of age) must be accompanied by a responsible adult under the authority of the beneficiary of the Legendary Tour or their replacement.
Children benefit, including where a specific fare is applied to them, from the same services as adults, with the exception of the Legendary Tour entitled “From Grasse to Saint-Paul-de-Vence • Wine Experience”, for which minor participants under the age of 18 do not take part in wine tastings and are instead offered non-alcoholic beverages such as sodas.
Passengers traveling with a child are asked to specify the child’s age at the time of booking, in order to allow provision of the most appropriate safety device (baby seat or booster seat).

  1.  Vehicle safety, regulatory compliance & responsible driving

At Happy French Riviera®, safety is not a constraint but a promise: that of offering each traveler a serene, smooth and fully controlled discovery experience.
Happy French Riviera® operates exclusively new and regularly maintained vehicles, compliant with applicable French and European standards, insured and authorized to operate within the scope of its professional activity.
Driving is carried out in strict compliance with the Highway Code, particularly with regard to speed limits, signage and right of way, with passenger safety and comfort prevailing at all times over any consideration of timing or itinerary.
Wearing a seat belt is naturally required for all passengers throughout the duration of the service and constitutes, for Happy French Riviera®, an essential measure for their protection.
In accordance with the rules applicable to the transport of children, Happy French Riviera® provides, free of charge, appropriate restraint devices suited to their morphology.
In a deliberately demanding approach, Happy French Riviera® applies internal safety standards exceeding common industry practices in order to guarantee a constant level of reliability, serenity and service quality.
To this end, Happy French Riviera®’s tourism escorts embody an internal culture of responsible driving, based on total abstinence from alcohol and narcotics before and during services, as well as compliance with rest periods, sleep and days off, ensuring constant vigilance and impeccable quality of accompaniment.
They also commit to driving in accordance with the Highway Code and speed limits, with passenger safety and well-being remaining the absolute priority.
These commitments form the foundation of the Happy French Riviera® experience and allow each passenger to enjoy their Legendary Tour in a safe, elegant, soothing environment conducive to the finest travel emotions.

  1. Adaptation of itineraries

Each Legendary Tour is designed, considered and planned to offer a smooth, immersive discovery experience that respects the announced highlights.
In order to preserve comfort, safety and experience quality, Happy French Riviera® reserves the right to make occasional adjustments to an itinerary based on traffic conditions, weather conditions or constraints beyond its control related to access routes.
The service is maintained as long as vehicle circulation is authorized by the competent authorities.
When weather conditions require particular attention while still allowing circulation, Happy French Riviera® adjusts the itinerary flexibly in order to preserve the smoothness and enjoyment of the discovery.
When circulation is restricted or prohibited on all or part of the route, the company prioritizes an alternative itinerary allowing the Legendary Tour to be maintained.
In the event of a total inability to operate the booked Legendary Tour on the scheduled day, Happy French Riviera® will coherently replace it with another equivalent itinerary, as most appropriate to the situation.
These adjustments are solely intended to offer the traveler the best possible experience, without ever altering the original promise of the service.

  1.   Insurance & authorizations

Happy French Riviera® carries out its activity in strict compliance with the regulatory framework applicable to passenger transport and tourist accompaniment.
The company holds the mandatory professional insurance policies covering all services offered, notably with regard to professional civil liability and passenger transport.
These guarantees are intended to protect travelers throughout the duration of the Legendary Tour, in compliance with applicable legal and regulatory provisions.

  1. . Limitation of liability

Happy French Riviera® cannot be held liable for damage resulting from the act of the client, third parties or a case of force majeure.
Each traveler naturally contributes to the quality and serenity of the Legendary Tour.

  1. . Cancellations & refunds

Any cancellation request must be made exclusively via the “Client Care” form accessible from the Happy French Riviera® website.
In accordance with Article L.221-28 of the Consumer Code, the fourteen (14)-day right of withdrawal does not apply to tourist services provided on a specific date or during a specific period, such as the Legendary Tours offered by Happy French Riviera®.
Any validation of payment constitutes firm confirmation of the reservation.
As Legendary Tours are organized on a fixed date and require dedicated resources, reservations are, in principle, non-cancellable and non-refundable.
Happy French Riviera® nevertheless invites the client, in the event of a personal impediment, to contact their banking institution in order to verify any possible coverage of their situation under the guarantees attached to their payment method.
Independently of these guarantees, Happy French Riviera® reviews with care and goodwill any request submitted via the “Client Care” form, within the limits of operational possibilities.

  1. . Personal data

Happy French Riviera® attaches particular importance to the protection of its travelers’ personal data.
The processing of such data is carried out in accordance with the Privacy Policy accessible on the website.

  1. . Applicable law – competent jurisdiction

These General Terms and Conditions of Sale are governed by French law.
Any dispute relating to their interpretation or execution falls within the exclusive jurisdiction of the French courts, and more specifically the Judicial Court of Nice, to which the parties expressly grant jurisdiction.

  1. . Amendments to the terms

Happy French Riviera® reserves the right to amend these General Terms and Conditions of Sale at any time in order to adapt them to changes in its services or in the regulatory framework.
The applicable version is the one in force on the date of reservation.

  1. . Final provisions

If any of the provisions of these General Terms and Conditions of Sale were to be declared null or unenforceable, the other provisions would remain fully valid.
These General Terms and Conditions of Sale constitute the entire agreement between Happy French Riviera® and the traveler for all services offered.

In any event, any service provided automatically gives rise to the issuance of an invoice compliant with the provisions of the French General Tax Code (Articles 256 et seq. and 289 et seq.), clearly showing the applicable VAT.
This invoice is issued in the name of the beneficiary of the Legendary Tour, as indicated at the time of booking, regardless of the identity of the payer, in accordance with the number of accompanying participants.

  1. Happy French Riviera® signature

Each service corresponds to access to one of the shared or private Legendary Tours, as described at the time of booking.
The Tours are carried out aboard a panoramic electric vehicle, ensuring silence, immersion and optimal visibility for each passenger, regardless of seating position.
In order to preserve authenticity and quality of interaction, each vehicle voluntarily accommodates a maximum of eight (8) participants.
Each Legendary Tour includes personalized accompaniment by a tourism escort to share the cultural, historical and natural heritage of the region, as well as all human, technical and logistical resources necessary for its execution.
Included are the elements expressly mentioned in the description of the selected Legendary Tour, such as, depending on the Tours concerned: the boat crossing to Saint-Tropez, access to certain museums, a negotiated 10% discount at Fragonard perfumery, certain meals, the use of a pedal boat or any other activity clearly indicated at the time of booking.
Not included are services not mentioned, personal expenses and gratuities.

  1. Prior information, transfers & meeting point

On the day before the Legendary Tour, the client automatically receives, at their contact email address:
– the exact departure time,
– the precise pick-up location,
– the first name and direct telephone number of the tourism escort,
– the vehicle registration number.
The client is invited to check their “junk / spam” folder. The message is sent from an official address ending in @happyfrenchriviera.com
In order to facilitate smooth communication on the day of the service, passengers are also asked to provide their WhatsApp number at the time of booking, as this application is a cost-free means of communication.
Happy French Riviera® does not voluntarily substitute itself for either the taxi market or the private hire vehicle (VTC) market.
The core of Happy French Riviera®’s activity lies in tourist accompaniment, the design and logistical organization of cultural and heritage-focused itineraries and excursions, and not in the provision of standalone transport services.
At the time of booking, the client may optionally request a private transfer provided exclusively by professional partners specialized in this type of service.
This option is particularly intended for participants staying outside Nice or lacking direct access to the departure point.
Selecting this option does not entail any obligation to subscribe to the transfer service. It merely allows the client, if they so wish, to select a partner suggested by Happy French Riviera® and to benefit, under the conditions specified at the time of order, from a negotiated 10% price advantage, in order to arrive calmly and on time at the designated meeting point.
When the client concludes an agreement directly with the suggested transfer provider, Happy French Riviera® acts exclusively as a facilitator of contact and cannot be held responsible for the execution of this service, which remains the sole responsibility of the provider concerned. No retro-commission is received by Happy French Riviera® in respect of this introduction.
The providers thus suggested have also adhered to the Happy French Riviera® ethical charter, guaranteeing a level of standards consistent with the brand’s values.
Regarding transfers from a place of residence located outside Nice to the meeting point marking the start of the Happy French Riviera® service, suggested providers are selected exclusively on the basis of punctuality, quality of service and propriety, in line with Happy French Riviera®’s own ethical standards, which are consistent with the spirit of the French Ministry of Tourism’s “Destination d’Excellence” label, independently of any volume-driven logic.
All shared Legendary Tours begin and end in Nice.
When access to the initial location in Nice is impossible (pedestrian zone, urban constraints), an alternative meeting point that is the closest and most convenient for the passenger is communicated and becomes the contractual pick-up location.

  1.  Maintenance of shared Legendary Tours

Each shared Legendary Tour is maintained regardless of group size, including in the presence of a single participant.
This policy reflects Happy French Riviera®’s commitment to offering each traveler a level of standards, availability and quality independent of any volume-based considerations.

  1.  Children, legal capacity & group representation

The first person named on the booking order is designated as the beneficiary of the Legendary Tour and acts as the sole representative of the registered group, regardless of whether or not they are the payer for the service.
The beneficiary must be of legal age under French law (18 years). They are the sole contractual contact for Happy French Riviera® for the entire group and are normally present during the Legendary Tour. In the event of an exceptional impediment, they may be replaced by another adult participant in the group, subject to prior notification to Happy French Riviera®, exclusively via the “Client Care” contact form accessible on the secure website https://www.happyfrenchriviera.com before the service departure.
Minor participants may only take part in a Legendary Tour if accompanied, for the entire duration of the service, by the adult beneficiary identified on the booking order or by the adult replacing them in accordance with the preceding paragraph.
Children (up to and including 15 years of age) must be accompanied by a responsible adult under the authority of the beneficiary of the Legendary Tour or their replacement.
Children benefit, including where a specific fare is applied to them, from the same services as adults, with the exception of the Legendary Tour entitled “From Grasse to Saint-Paul-de-Vence • Wine Experience”, for which minor participants under the age of 18 do not take part in wine tastings and are instead offered non-alcoholic beverages such as sodas.
Passengers traveling with a child are asked to specify the child’s age at the time of booking, in order to allow provision of the most appropriate safety device (baby seat or booster seat).

  1.  Vehicle safety, regulatory compliance & responsible driving

At Happy French Riviera®, safety is not a constraint but a promise: that of offering each traveler a serene, smooth and fully controlled discovery experience.
Happy French Riviera® operates exclusively new and regularly maintained vehicles, compliant with applicable French and European standards, insured and authorized to operate within the scope of its professional activity.
Driving is carried out in strict compliance with the Highway Code, particularly with regard to speed limits, signage and right of way, with passenger safety and comfort prevailing at all times over any consideration of timing or itinerary.
Wearing a seat belt is naturally required for all passengers throughout the duration of the service and constitutes, for Happy French Riviera®, an essential measure for their protection.
In accordance with the rules applicable to the transport of children, Happy French Riviera® provides, free of charge, appropriate restraint devices suited to their morphology.
In a deliberately demanding approach, Happy French Riviera® applies internal safety standards exceeding common industry practices in order to guarantee a constant level of reliability, serenity and service quality.
To this end, Happy French Riviera®’s tourism escorts embody an internal culture of responsible driving, based on total abstinence from alcohol and narcotics before and during services, as well as compliance with rest periods, sleep and days off, ensuring constant vigilance and impeccable quality of accompaniment.
They also commit to driving in accordance with the Highway Code and speed limits, with passenger safety and well-being remaining the absolute priority.
These commitments form the foundation of the Happy French Riviera® experience and allow each passenger to enjoy their Legendary Tour in a safe, elegant, soothing environment conducive to the finest travel emotions.

  1. Adaptation of itineraries

Each Legendary Tour is designed, considered and planned to offer a smooth, immersive discovery experience that respects the announced highlights.
In order to preserve comfort, safety and experience quality, Happy French Riviera® reserves the right to make occasional adjustments to an itinerary based on traffic conditions, weather conditions or constraints beyond its control related to access routes.
The service is maintained as long as vehicle circulation is authorized by the competent authorities.
When weather conditions require particular attention while still allowing circulation, Happy French Riviera® adjusts the itinerary flexibly in order to preserve the smoothness and enjoyment of the discovery.
When circulation is restricted or prohibited on all or part of the route, the company prioritizes an alternative itinerary allowing the Legendary Tour to be maintained.
In the event of a total inability to operate the booked Legendary Tour on the scheduled day, Happy French Riviera® will coherently replace it with another equivalent itinerary, as most appropriate to the situation.
These adjustments are solely intended to offer the traveler the best possible experience, without ever altering the original promise of the service.

  1.   Insurance & authorizations

Happy French Riviera® carries out its activity in strict compliance with the regulatory framework applicable to passenger transport and tourist accompaniment.
The company holds the mandatory professional insurance policies covering all services offered, notably with regard to professional civil liability and passenger transport.
These guarantees are intended to protect travelers throughout the duration of the Legendary Tour, in compliance with applicable legal and regulatory provisions.

  1. . Limitation of liability

Happy French Riviera® cannot be held liable for damage resulting from the act of the client, third parties or a case of force majeure.
Each traveler naturally contributes to the quality and serenity of the Legendary Tour.

  1. . Cancellations & refunds

Any cancellation request must be made exclusively via the “Client Care” form accessible from the Happy French Riviera® website.
In accordance with Article L.221-28 of the Consumer Code, the fourteen (14)-day right of withdrawal does not apply to tourist services provided on a specific date or during a specific period, such as the Legendary Tours offered by Happy French Riviera®.
Any validation of payment constitutes firm confirmation of the reservation.
As Legendary Tours are organized on a fixed date and require dedicated resources, reservations are, in principle, non-cancellable and non-refundable.
Happy French Riviera® nevertheless invites the client, in the event of a personal impediment, to contact their banking institution in order to verify any possible coverage of their situation under the guarantees attached to their payment method.
Independently of these guarantees, Happy French Riviera® reviews with care and goodwill any request submitted via the “Client Care” form, within the limits of operational possibilities.

  1. . Personal data

Happy French Riviera® attaches particular importance to the protection of its travelers’ personal data.
The processing of such data is carried out in accordance with the Privacy Policy accessible on the website.

  1. . Applicable law – competent jurisdiction

These General Terms and Conditions of Sale are governed by French law.
Any dispute relating to their interpretation or execution falls within the exclusive jurisdiction of the French courts, and more specifically the Judicial Court of Nice, to which the parties expressly grant jurisdiction.

  1. . Amendments to the terms

Happy French Riviera® reserves the right to amend these General Terms and Conditions of Sale at any time in order to adapt them to changes in its services or in the regulatory framework.
The applicable version is the one in force on the date of reservation.

  1. . Final provisions

If any of the provisions of these General Terms and Conditions of Sale were to be declared null or unenforceable, the other provisions would remain fully valid.
These General Terms and Conditions of Sale constitute the entire agreement between Happy French Riviera® and the traveler for all services offered.
